Lindsay Lohan did not make any demands for Adderall in rehab plea deal



Lindsay Lohan's lawyer is scoffing at a report the actress agreed to rehab only if the facility allowed her to take Adderall.

According to TMZ.com, the "Liz & Dick" star takes the psychostimulant for attention deficit hyperactivity disorder on a daily basis and was prepared to go ahead with a trial in her recent lying-to-cops case unless her ongoing Adderall use was attached to her plea deal.

The deal, approved by a California judge two weeks ago, includes 90 days of residential rehab, 18 months of psychological counseling and 30 days of community service.

Lohan's lawyer Mark Heller said the no-jail plea agreement did not include an Adderall rider.
"That was never a part of any discussion with the prosecutors or the court. That was never an issue we addressed,"Heller said Monday.

"Prosecutors or the court would never interject themselves into medical determinations," he said.

"Patients traditionally apprise facilities of what medications, if any, they're prescribed, and after a full series of medical evaluations, each facility determines what medications, if any, are going to be allowed. This is never dictated by the patient. It's always determined by medical staff who are well qualified."



One of Lohan's 2010 probation reports said the scandal magnet had been taking the amphetamine-based prescription drug "for as long as she can remember."

The report listed her other prescriptions as the antidepressants Zoloft and trazadone and the powerful opiate Dilaudid.
Heller said Monday he was “considering a number of different facilities” that meet Lohan's court-ordered needs.

She has until May 2 to enroll in rehab or risk immediate jail.

Sources previously said Lohan planned to do the rehab time in New York, but Heller said he wasn't ruling out other areas.

“I don't know where it will happen yet," he said. “We want to make a measured and intelligent choice. I'm hoping this week we'll be in a position to assess what's next."

The judge said Lohan can't leave the facility on "day passes" because the treatment is in lieu of jail.
“It doesn't have to be locked like a correctional facility. It doesn't have to be that hardcore. But it has to be a place where if she leaves, they notify us," Santa Monica City Attorney Terry White previously told The News.

“She has to follow the program and can't leave the property," White, a key prosecutor behind her deal, said. "If she leaves, it's a violation."
