- Judge Jennifer Scheter reviewed evidence brought by Dr. Luke's legal team and decided to expand his legal action towards the artist formerly known as Ke$ha
- Kesha is currently being sued by Dr Luke for defamination as retallation for Kesha's civil suit against him in 2014
- Dr Luke's legal team is upset that Kesha's former lawyer talked to the media about Kesha's civil suit and allegations about him
- This is unusual because "statements made by lawyers in the course of litigation are often deemed privileged and non-actionable.”
- His legal team say that Kesha and her team used the media's reporting to get Kesha out of her recording contract and manipulate the public against Dr Luke
- An email from 2012 between Kesha's manager Ken Levitan and Irving Azoff, a powerful music industry figure, said the following:
Ken L.: [Kesha] beyond despises Luke
Irving A.: Get me in the mix. I will ruin him.
Ken L: We need the album done and its close...there are huge hits on it...let’s ruin him after he delivers.
- Another piece of evidence was a memo from Kesha's PR representive company Sunshine Sachs which said:
"Our goal is to help extricate CLIENT K from her current professional relationship with PERSON Lby inciting a deluge of negative media attention and public pressureon the basis of the horrific personal abuses presented in the lawsuit."
- An email between Kesha's management and TMZ was also submitted as evidence where they discussed Kesha's potential lawsuit before she filed against Dr Luke
- Judge Scheter wrote that one "could possibly conclude that the California complaint [Kesha's lawsuit] was a sham maliciously filed soley to defame plaintiffs as part of Kesha’s alleged campaign to destroy Gottwald as leverage to renegotiate her contracts
- Kesha is contractually obligated to work with Dr Luke for 2 more albums
